Terms & Conditions

These terms govern the relationship between The Living Garden Co. and any person who engages us to provide garden design, renovation or maintenance services. By engaging our services, you agree to these terms.

Who we are

The Living Garden Co. is a garden design, renovation and maintenance business based in Watford, Hertfordshire, operated by Pieter Meiring. Contact: livinggardencompany@gmail.com.

Our services

We provide garden design and planning, garden renovation and revamp, and garden maintenance — on a one-off or regular basis. The scope, price and timeline for each project will be confirmed before any work begins. No work will start until you have accepted our quote.

Quotes and pricing

All quotes are valid for 14 days from the date issued. If the scope of work changes materially, we reserve the right to revise the price with your agreement.

For larger projects we may request a deposit of up to 30% before work begins. The balance is due within 7 days of completion unless otherwise agreed in writing. For ongoing maintenance, invoices are issued monthly and due within 14 days.

Payment

Payment is accepted by bank transfer — details will be on your invoice. We reserve the right to charge interest on overdue invoices at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellation

You may cancel or reschedule a booking with at least 48 hours’ notice at no charge. Cancellations with less than 48 hours’ notice may be charged at 50% of the agreed fee for that visit.

For larger projects, if you cancel after work has begun, you will be charged for work completed to date plus any materials purchased on your behalf that cannot be returned.

We reserve the right to cancel or reschedule due to adverse weather, illness or circumstances beyond our control. We’ll notify you as soon as possible and arrange an alternative at no extra cost.

Plants and materials

Where we source plants or materials on your behalf, these will be charged at cost plus a reasonable sourcing fee, as detailed in your quote. We take care to source healthy, suitable plants, but cannot guarantee establishment once planted — this depends on weather, soil conditions and aftercare.

Watering and aftercare guidance will be provided at handover. We cannot be responsible for plant failure where this guidance has not been followed.

Access and working conditions

You agree to provide reasonable access to the property at agreed times. If access is unavailable on arrival through no fault of ours, the visit may be charged in full.

We will treat your property with care and respect. Any accidental damage will be reported promptly and we will work with you to resolve it fairly.

Our liability

We carry public liability insurance. Our liability to you is limited to the value of the services provided under the relevant quote or contract.

We are not liable for loss or damage caused by circumstances beyond our reasonable control, failure of plants to establish where aftercare guidance has not been followed, pre-existing conditions we were not made aware of, or indirect or consequential loss of any kind.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Your responsibilities

  • Provide accurate information about your garden, including any known hazards

  • Ensure children and pets are kept clear of the working area during visits

  • Follow aftercare guidance we provide

  • Pay invoices on time

Photographs and portfolio

We may photograph your garden during and after our work, and use these images on our website, social media and in promotional materials. If you’d prefer we don’t photograph your garden, please let us know in writing and we will respect your wishes entirely.

Complaints

If you’re unhappy with any aspect of our service, please contact us at livinggardencompany@gmail.com within 14 days of the issue arising. We will acknowledge your complaint within 3 working days and aim to resolve it fairly and promptly.

Governing law

These terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. The current version will always be available on our website. Continuing to use our services after any changes constitutes acceptance of the updated terms.
